The present Terms and Conditions are valid for the school :

LYON BLEU INTERNATIONAL

Hereinafter referred to as “the SCHOOL”.

By placing a reservation request with the SCHOOL, the student certifies that he/she has read, understood and unreservedly accepts the present General Terms and Conditions of Sale in force on the day the order is placed.

Presentation: THE SCHOOL is a training organization that develops, offers and delivers face-to-face and distance learning courses in French as a foreign language (FLE). The training action falls into the category of training actions (defined by articles L 6313-1 et seq. of the French Labor Code) ” action to acquire, maintain or improve knowledge “. Legal information (business number, SIREN, registered office address) is indicated on the SCHOOL training contract provided at the time of registration.

1 / REGISTRATION AND PAYMENT TERMS STAY RULES
1.1 - For all students registering for SCHOOL:

To register, use the registration form available on the SCHOOL website or contact one of our pedagogical advisors.

A deposit of €200 is required to confirm registration. The amount of this deposit will be 30% of the total cost of the course in the case of registration requiring a visa or residence permit.

In addition to the course fees indicated on the price sheets, students must pay a non-refundable registration fee of €80 for face-to-face courses and €30 for online courses.

The balance is due on receipt of the final payment request, which must be received no later than 30 days before the start of the service. In the event of late registration (less than 30 days before the start of the course), full payment will be required.

In the event of non-payment within 30 days of the course start date, the SCHOOL reserves the right to cancel the course registration and accommodation reservation (if applicable).

Students may pay for their stay (at their choice) by credit card, by bank transfer to the SCHOOL’S bank account (bank details provided in the booking documents) or by cheque in EUROS made payable to the SCHOOL, subject to payment being made at least 15 days before the start of the course.

Payment must be made in euros, regardless of the means of payment used. Any bank charges related to payment methods are the sole responsibility of the student.

1.2 - For long stays requiring obtaining an entry visa for France:

In the event of registration requiring a visa/residence permit, the student undertakes to begin visa application procedures early enough to ensure that registration runs smoothly (at least 2 months in advance).

The SCHOOL cannot be held responsible for any conditions or changes concerning entry or residence formalities in France.

A pre-registration letter will be sent electronically (email) after receipt of the deposit payment in accordance with article 1.1 of these GTC.

1.2.1 - If you obtain a visa

The student must inform the SCHOOL as soon as the visa has been granted by the French authorities.

Once the visa/residence permit has been obtained, and no later than 15 days before the start of the course, the SCHOOL will request full payment of the remaining balance as indicated in article 1.1 of these GCS.

If the SCHOOL has not received the necessary information, a reminder email will be sent 30 days before the start of the course. If no response is received within 72 hours, the reservation procedure may be suspended and the authorities (embassy/prefecture) will be informed.

1.2.2 - In the event of a delay in obtaining a visa

The student can maintain the initial course start date or change it:

  • If the student wishes to keep the original dates, and is certain that the visa will be issued on time, the SCHOOL will request full payment of the outstanding balance no later than 30 days before the course start date.
  • If the student wishes to change the start date because the visa will be issued too late, the start date can be postponed once at no charge. This change will require the SCHOOL to provide a new pre-registration certificate with the updated dates.
  • After the first postponement request, any new postponement request will be billed at €80. However, in this case, the SCHOOL cannot guarantee the original accommodation conditions.
1.2.3 - In the event of a visa refusal (duly certified by an official document)

The visa is refused and the student must cancel his program:

  • If cancellation is requested more than 18 days before the course start date, a fee of €100 will be deducted.
  • If the cancellation request is received less than 18 days before the course start date, 10% of the course price (up to a maximum of €450) will be retained. Registration fees will not be refunded.

All bank charges generated by the refund transaction are the responsibility of the student. Please note that the refund will be made to the person who made the initial payment and on the payment method used at the time of the booking request.

2 / CONDITIONS OF MODIFICATION AND/OR CANCELLATION OF STAY

No refund for any service whatsoever will be given for late arrival or early departure. Any course started is due in full.

Registration and accommodation fees are non-refundable.

2.1 - General case
  • If cancellation is requested more than 30 days before the course start date, the deposit paid will be refunded, less the €80 registration fee.
  • If the cancellation request is made between 29 and 18 days before the start of classes, the advance payment (up to 450€) will not be refunded.
  • If the cancellation request is made 8 days or less before the course start date, a penalty of 50% of the price of the course and accommodation, capped at €2,000, will be retained.
  • If the cancellation request is received between 17 and 9 days before the course start date, a penalty of 50% of the course price, up to a maximum of 800 euros, will be deducted, as well as 100% of the price of the first week’s accommodation.

All bank charges generated by the refund transaction are the responsibility of the student. The SCHOOL undertakes to reply within 1 week, the date of dispatch of the cancellation request being taken as proof. Refunds will be made within 60 days of receipt of supporting documents.

A group course cannot be converted into an individual course or vice versa at the student’s request. The student may request a change of group program for a value and duration equal to or greater than the budget and duration initially committed. The request will be accepted subject to the SCHOOL’s availability and will be validated only after payment of any supplement.

2.2 - Force majeure (illness, death, etc.) family, accident resulting in injury):

Each party will be exonerated from all liability in the event of a total or partial breach, even temporary, of any of its obligations under the training contract, caused by Force Majeure. For the purposes of the contract, Force Majeure is defined as an insurmountable and irresistible event resulting from a cause beyond the control of the parties, such as an event or series of events of a climatic, bacteriological, military, political or diplomatic nature.

Wherever possible, and depending on the educational content required, the School undertakes to implement educational continuity using digital media, or to reposition training courses.

In the event of force majeure, the Student will nevertheless remain liable for payment pro rata-temporis of the training services provided by the SCHOOL.

In the event of the death of a father, mother, brother or sister, descendant or spouse after the start of the course, a death certificate as well as a document proving the family relationshiṕ and a return plane ticket (if applicable) must be produced to the school management.

In the event of illness occurring after the start of the course and necessitating a definitive return to the country of origin (e.g. specialist treatment), partial reimbursement will be made on presentation of a medical certificate issued by a doctor established in France, together with any evidence of force majeure, and a return air ticket purchased after the onset of the illness. Any illness that can be treated in France will not be reimbursed.

In these two cases only, unused course hours are reimbursed (any week started is due) with a penalty corresponding to one week of the chosen program and accommodation. Registration fees are non-refundable.

Professional requirements or studies in France or abroad are not considered as force majeure.

The risk associated with the Covid 19 epidemic is not considered a case of force majeure and cannot justify a request for program interruption and reimbursement. In the event that the SCHOOL is forced to close due to a government decision, courses will be delivered online as part of our educational continuity programs without any claim for reimbursement.

Cancellation request. All requests for cancellation and reimbursement for reasons of force majeure must be made in writing to the SCHOOL management and accompanied by supporting documents. This request can be made either before the start of the program or during the program. Reimbursement of expenses may be considered subject to presentation of supporting documents (sworn translation into French or English) and acceptance of the request by the SCHOOL.

2.3 - Request for modification, postponement of dates and/or moving the start date or end of course

Students may also choose to postpone the start date of their course and their arrival in the accommodation if their program has not yet begun, or to postpone the end date of their course and their departure from the accommodation if their request is made during the course of their program, in accordance with the conditions set out below.

Requests must be e-mailed to the SCHOOL management at least 30 days before the course start date. This period may be shorter in cases of force majeure only. The student then has 2 months from the date of receipt of the postponement request e-mail to inform us of the new date chosen and pay an additional administrative fee of €80. The new course must start no later than 6 months after the date of the postponement request.

Move the end of the course to a later date. This request can only be accepted in cases of force majeure. The request must be sent by email to the educational advisor, specifying the new end date and paying an administrative fee of €80. The new end date cannot exceed 6 months beyond the initial end date.

For people staying with a host family, in a hotel or in a residence: see article 4 ” Accommodation ” of these General Terms and Conditions of Sale.

Move the date of an individual lesson. For private lessons, less than 48 hours before the lesson, no change of time or date will be accepted once the schedule has been approved. The course will therefore be counted as completed by the student, who may not claim any refund or compensation of any kind.

Request for vacation during a long stay.

It is possible to request a vacation period (interruption) by sending a written request by e-mail to the educational advisor at least 18 days before the desired vacation start date and according to the following conditions:

  • 2 consecutive weeks maximum for 13 to 24-week registrations
  • 2 x 2 consecutive weeks maximum for registrations of 25 weeks or more.

The new program end date will be calculated according to the number of weeks of vacation taken. Vacations must be taken starting on a Monday.

After the first request, an administrative fee of €80 will be charged for each new vacation request.

If the student is staying with a host family, and in the event of absence during his/her vacation, and if he/she wishes to retain the benefit of his/her accommodation, the rate will be reduced to 120€/week, whatever the plan chosen and subject to acceptance by the host family.

Extended stay. The extension of a stay is possible under certain conditions, and is therefore not systematically accepted when requested. Students should contact their academic advisor, who will check availability for both courses and accommodation. The request must be made by e-mail.

3 / PEDAGOGICAL ORGANIZATION

Minimum age :

  • Adult center: to be admitted to the SCHOOL, students must be 18 years old, or 16 with parental consent.
  • Junior center: to be admitted to the SCHOOL’s junior center, students must be between 13 and 16 years of age.

Vacations: The school is open all year round except for the two weeks of the year corresponding to the Christmas vacation. The school will be closed on French public holidays except on certain days specified by the SCHOOL. Public holidays will not be made up or compensated.

These dates are shown on the calendar published on our website.

Number of pupils per class. The SCHOOL makes every effort to guarantee a maximum of 14 pupils per class, with an average of 12.

Level test. All students must take a written placement test before arrival. The minimum level for participation in our general French courses is A1 (false beginner).

For complete beginners, course integration can only take place on the specific dates mentioned on the calendar on the L’ÉCOLE website. Complete beginners must complete the KLF online module before their first course (free of charge). Late entry is possible (up to two weeks after the specific course start date), provided you take the KLF online beginners’ module (€49).

4 / ACCOMMODATION

The SCHOOL acts as agent on behalf of the student and the accommodation provider (host family, residence or any other form of accommodation).

  • Family accommodation: arrival on Sunday, departure on Saturday. Any additional night will be charged at the current rate.

People who have asked the SCHOOL to find them accommodation and who wish to change the type of accommodation once they have arrived must submit a reasoned and documented request to the management.

However, management reserves the right to refuse such a change if the reasons given by the person do not seem sufficient, or if the SCHOOL provides a satisfactory solution. In this case, if the student persists in his or her request for a change, the management may grant the change and charge a change fee of €80.

Students wishing to extend their stay/accommodation should check availability ideally 2 weeks before the start of the new period. To do so, they should contact the SCHOOL’s educational advisors.

Students who wish to extend their stay but (1) request a change of host family or residence, or (2) are unable to stay in the same accommodation due to lack of availability, will be required to pay a new accommodation reservation fee.

Students must read and accept the rules and conditions of the accommodation they are staying in, and refer to them in the event of cancellation or early departure, including cases of force majeure.

No refund of sums already paid for accommodation with a family can be requested for late arrival or early departure (except in cases of force majeure – Cf. article 2.2 of these GCS).

In July and August, the school cannot guarantee accommodation with a family if registrations are made less than 18 days before the start of the desired course.

5 / TRANSFER AND TRAVEL

The SCHOOL acts as agent on behalf of the student and the carrier.

Students wishing to benefit from a transfer to their place of residence upon arrival in France must inform L’ÉCOLE at the time of booking, either via the L’ÉCOLE website or in writing by sending an e-mail to their educational advisor no later than 7 days before arrival.

The student must provide precise arrival details (flight/train number and exact time) and an active contact telephone number in France no later than 7 days before arrival. No reimbursement will be made if the student misses an appointment with the transporter.

6 / INSURANCE

The SCHOOL has taken out insurance to protect property and individuals on its premises and on field trips.

Health, accident and liabilitý insurances are compulsory and payable by students. In particular, it is the student’s responsibility to check that he/she is properly insured for any medical expenses or travel cancellation with a reputable company. A copy of the insurance certificate may be requested by either THE SCHOOL or the host.

Students’ objects, effects, furniture, vehicles and valuables are not covered against theft, loss or damage, whatever the cause. It is therefore the student’s responsibility to take out any insurance he or she deems necessary to guarantee his or her personal property.

For students staying in residence or with a host family, it is the responsibility of the student/trainee to take out civil liabilitý insurance protecting him/her against the risk of damage and/or breakage in his/her accommodation.

7 / DATA PROTECTION PERSONAL / RGPD

The personal information collected as part of the student’s registration is stored in a computerized database designed and secured by FIDELO SOFTWARE and HUBSPOT. The person responsible for processing information within the SCHOOL is the Center Director.

We will only process or use your data insofar as this is necessary to contact you, process your requests, create and manage your user profile, create and manage your access to our online services, ensure the performance of our services, commercial prospecting, carry out statistical studies, comply with our legal obligations.

Personal information will be retained for as long as necessary after you have completed your training with the SCHOOL. During this period, we take all necessary steps to ensure the confidentiality and security of your personal data, so as to prevent damage, deletion or access by unauthorized third parties.

Access to your personal data is strictly limited to our teaching and administrative staff (teaching, accounting and communication), and, where applicable, to our service providers (hosts). The latter are subject to an obligation of confidentiality and may only use your data in accordance with our contractual provisions and applicable legislation.

Apart from the cases set out above, we undertake not to sell, rent, transfer or give third parties access to your data without your prior consent, unless we are obliged to do so for a legitimate reason (legal obligation, fight against fraud or abuse, exercise of rights of defence, etc.).

In accordance with the French Data Protection Act of January 6, 1978, as amended, and European Regulation no. 2016/679/EU of April 27, 2016 (applicable from May 25, 2018), students have the right to access, rectify, port and delete their data, or to limit the processing.

Students may also, for legitimate reasons, object to the processing of data concerning them. He may, subject to the production of valid proof of identity, exercise his rights by contacting the data controller by post or email at the following addresses:

Acceptance of the General Terms and Conditions at the time of the enrolment application constitutes, without reservation, an expression of the free, specific, informed and unambiguous will of the Student, who accepts that personal data concerning him/her may be processed.

Cookie management: A cookie is a small text file saved on the user’s computer or mobile device and retrieved during subsequent visits. The SCHOOL uses cookies to make your visit to the site easier and more enjoyable. We do not use cookies to store personal information or to disclose information to third parties. There are two types of cookies, permanent and temporary (session cookies). Permanent cookies are stored in the form of a file on the computer or mobile device used for a period not exceeding 12 months. Session cookies are stored temporarily and disappear as soon as the browsing session is closed. You can easily delete cookies from your computer or mobile device using your browser. For instructions on how to manage and delete cookies, please refer to the help section of your browser. Depending on your preferences, you can deactivate cookies or ask to be notified each time a new cookie is sent to your computer or mobile device. Please note that if cookies are deactivated, it is no longer possible to take full advantage of all functions.

Management of third-party cookies: The SCHOOL uses third-party cookies to collect statistics in aggregate form in analysis tools such as Google Analytics. These cookies may be permanent or temporary (session cookies). Permanent cookies are stored on the computer or mobile device used for no longer than 24 months.

Use of images: KLF and its schools reserve the right to take photos of students during courses, workshops and cultural activities, unless they explicitly object. Any objections must be notified no later than the student’s arrival at the school.

This authorization authorizes the use of images for communication purposes, whether for distribution within the school or via our multimedia supports (such as brochures, advertisements or websites) with the aim of promoting the activities of our schools. Authorization to use the image is granted free of charge. Any distribution by KLF must be free of charge. Any commercial use of the images will require a new request for authorization.

Acceptance of these general terms and conditions of sale implies acceptance of these terms relating to image rights.

8 / TERRITORIAL JURISDICTION

The parties agree that any dispute arising in connection with the present training contract shall be referred to the French courts having territorial jurisdiction according to the location of the SCHOOL’s head office.
